Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of mylink.bz, including its website, dashboard, AI agents, automations, pages, short links and related services (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you disagree with any part of these Terms, you may not use the Service.

If you use the Service on behalf of a business, you confirm you have authority to bind that business, and "you" means that business.

2. Who we are

The Service is provided by mylink.bz ("mylink.bz", "we", "us" or "our"). You can reach us at ryan@baggottsbots.com or (843) 505-1657. Parts of the Service are built on technology licensed from third-party providers; your contract for the Service is with us, so contact us about your account, billing or support.

3. Accounts

• You must register for an account to use the Service, and you must be at least 18 years old.
• You agree to give accurate and complete information and to keep it updated.
• You are responsible for keeping your account and password secure and for all activity under your account, including activity by team members and sub-accounts you invite.
• Tell us right away at ryan@baggottsbots.com if you suspect unauthorized access to your account.

4. The Service

Depending on your plan, the Service may include AI chat and voice agents, workflow automations, a contact and pipeline CRM, SMS, email, WhatsApp and social messaging, landing pages and forms, short links, appointment booking, payments and checkout tools, and AI image, audio and video generation.

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription. We may add, change or remove features at any time. Beta or preview features are provided as-is and may be discontinued.

5. Subscription, trial and payments

• Free trial. The Service is subscription-based and includes a 7-day free trial. When the trial ends, your payment method is charged the subscription fee unless you cancel before the trial ends.
• Charges. You are responsible for all charges incurred under your account. Payments are processed by Stripe; we do not store your full card details on our servers.
• Usage charges. AI agent accounts that exceed 1,000 messages per calendar month may be subject to additional usage-based charges. Other features, such as messaging, calling, AI generation and phone numbers, may also be charged by usage or drawn from credits.
• Refunds. Subscription fees are non-refundable, including for partial periods or unused features.
• Cancellation. You may cancel at any time and will keep access through the end of your current billing period.
• Price changes. Pricing may change at any time at our sole discretion. Continuing to use the Service after a price change means you accept the new pricing.
• Taxes. Fees exclude applicable taxes, which are your responsibility.

6. Platform SMS usage

The Service provides SMS messaging using a shared phone number. Each account receives a limited number of free platform SMS messages per month. When those are used up, you can buy SMS credit packs.

• SMS credits are non-refundable. Paid credits do not expire.
• Free monthly credits reset at the start of each calendar month, and unused free credits do not roll over.
• If you connect your own Twilio credentials and phone numbers, you are not subject to platform SMS metering or charges.
• Platform SMS is provided on a best-effort basis and delivery is not guaranteed. Standard carrier messaging rates may apply to recipients.

7. Third-party services and API keys

The Service connects to third-party services such as AI model providers, telephony and messaging carriers, payment processors, social networks, calendars and cloud storage. When you connect those services or supply your own API keys:

• Your use of each third-party service is governed by its own terms and policies, which you must follow.
• You are responsible for charges billed to you directly by those providers, including usage on keys you supply.
• We are not responsible for the availability, accuracy or conduct of third-party services, or for changes they make that affect the Service.

8. Google API data usage

When you connect a Google account (Calendar, Sheets, Docs, Drive or Gmail), we handle data received from Google APIs in line with the Google API Services User Data Policy, including its Limited Use requirements. We do not use Google user data to train generalized AI models, we do not sell it, and we do not transfer it to advertisers. Agents that read from a Google API are technically blocked from being served by our DeepSeek fallback. See our Privacy Policy for details.

9. Messaging and calling compliance

You are the sender of every message and call made through your account, and you are responsible for complying with all laws and carrier rules that apply, including the TCPA, CAN-SPAM, state telemarketing and AI-disclosure laws, GDPR and similar privacy laws, carrier A2P 10DLC and toll-free registration requirements, and Meta/WhatsApp business messaging policies. You agree to:

• Get and keep records of valid consent before sending marketing texts, emails or calls, or using automated or AI voices.
• Honor opt-out requests (such as STOP or unsubscribe) promptly.
• Identify your business in your messages and only message during permitted hours.
• Not use purchased, rented or scraped contact lists.

We may block or delay messages, release phone numbers, or suspend messaging features if we see high complaint rates, carrier violations or suspected abuse. Carrier fees and fines caused by your messaging are your responsibility.

10. AI-generated content

• AI output can be inaccurate, incomplete or offensive. You are responsible for reviewing it and for everything your agents say or do on your behalf, including bookings, quotes and promises to your customers.
• Do not rely on AI output as professional legal, medical, financial or other regulated advice.
• You must tell people they are interacting with an AI where the law requires it.
• As between you and us, you own the output you generate, subject to third-party rights and the terms of the underlying AI providers.

11. Acceptable use

You may not use the Service for any illegal purpose or unlawful activity, including:

• Fraud, phishing, scams or other deceptive practices.
• Distributing malware or other harmful content.
• Violating intellectual property rights.
• Harassing, abusive, hateful or harmful communications, or spam.
• Interfering with the operation or security of the Service.
• Collecting personal data of others without consent, or violating data protection laws including GDPR.
• Impersonating any person or business, or creating fake reviews or records.
• Creating or sharing sexual content involving minors, non-consensual intimate imagery, or deceptive deepfakes or AI voices of real people without consent.

12. Links, pages and short links

Pages, forms and short links created in the Service may be served from mylink.bz domains or domains you connect. You are responsible for every destination your links point to and for all content on your pages. We may disable or remove, without notice, any link or page we believe points to malware, phishing, spam or illegal content, breaks these Terms, or puts our domains' reputation at risk. Short links are not guaranteed to be permanent and may stop working when your account ends.

13. Your content

You keep ownership of any content you create, upload or share through the Service. By providing content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate and distribute it in connection with the Service.

14. Data protection responsibilities

If you use the Service to collect or process personal data of your customers or end users:

• You are the data controller for that data, and mylink.bz acts as a data processor.
• You are responsible for obtaining the necessary consents from your users.
• You will comply with applicable data protection laws, including GDPR and CCPA.
• You will respond to data subject requests in a timely manner.

15. Our intellectual property

The Service and its content, features and functionality are owned by mylink.bz and its licensors and are protected by copyright, trademark, patent, trade secret and other intellectual property laws. These Terms do not transfer any of those rights to you.

16. Termination

We may terminate or suspend your account and access to the Service without prior notice or liability for any reason, including breach of these Terms. On termination, your right to use the Service ends immediately.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. After account deletion, we delete or anonymize your personal data as described in our Privacy Policy.

17. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that messages or calls will be delivered, or that AI output will be accurate.

18. Limitation of liability

In no event shall mylink.bz or its officers, directors, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of, or inability to use, the Service.

19. Indemnification

You agree to indemnify and hold harmless mylink.bz from any claims, damages or expenses arising from your violation of these Terms or your use of the Service, including your messages, calls and AI agents.

20. Governing law and disputes

These Terms are governed by the laws of the United States and the State of South Carolina, without regard to conflict-of-law provisions.

Any dispute arising from these Terms or your use of the Service will first be addressed through good-faith negotiation. If it cannot be resolved that way, it will be settled by binding arbitration under the rules of the American Arbitration Association.

21. Changes to these Terms

We may modify these Terms at any time. We will give notice of significant changes by email and by posting the new Terms here with an updated "Last updated" date. Continuing to use the Service after changes means you accept the new Terms.
